Notice of New Fee; Federal Lands Recreation Enhancement Act (Title vnr, Pub. L. 108-447)

AGENCY: National Forests in Florida, Ocala National Forest. USDA Forest Service.

ACTION: Notice of New Fee Site

SUMMARY: The USDA Forest Service proposes a new fee site that will involve a special recreation permit for each operator using the Ocala National Forest designated off-highway vehicle trail system.

There would be a choice between a three-consecutive day permits ($15) or an annual permit (proposed to be between $60 and up to $120 pending [mal financial and marketing analysis, public input, and agency review).

The Forest Service will use funds generated to sustain the trail system, facilities, patrols, and monitoring.
The Ocala National Forest is committed to providing quality motorized recreation in balance with what the land can support. The Ocala National Forest recently designated approximately 150 miles of off-highway vehicle trails for motorcycles and unlicensed all-terrain vehicles that consist of mixed-use roads, ATV/motorcycle trails, and motorcycle-only trails.

Analysis has begun to consider additional designated trails on the Ocala National Forest which would be included in the fee permit system.


DATES: The proposed fee would be initiated no sooner than April 1, 2007. COmments, concerns, or questions on this proposal must be submitted by October 30, 2006.

I thought the money generated from the green registration sticker was to go to issues like this.... Tried to call Bret all I got was voice mail

Not positive but I think green sticker is a state program, and the money goes to state areas, like Croom. ONF is federal so they don't get any state money.
In general, I like the fee system because it gives the FS a financial incentive to provide OHV trails.

i agree- with land being 20grand an acre when you can find it that cheap, i'd be willing to pay 120.00 a year from now on and forever to have thousands of acres of land to take my family to to ride and camp-seems like a bargain to me. it sure beats having 50grand worth of bikes and toy haulers sitting at the house with nowhere to ride.

Totally agree, maybe they should charge by the wheel. 2 Wheels pay XX &amp; 4 Wheelers pay XXXX because they in all honesty do ten times the damage 2 wheels do IMHO.

I think a fellow FTR member posted ?some Pics ?of the new “Trail” system on the forum recently. If they are going to charge for a quality trail system that would be one thing but I question the type of trail they are providing. I cant see paying money to ride down a jeep road. Is single track only a fading memory?

The volunteers down at delancey are putting out bad info. When ever I go down to delancey the volunteers come up to the campsites and inform us of the new trail system and how the the green stickers on the atv's and bikes are going to start being enforced. Reason behind the green stickers was to collect money to maintain the trail system and provide funds for new ORV trails in other areas. I guess two agencies are pulling money out off the cookie jar

First - the green sticker that I believe you have to have on your bikes is for theft purposes, and some of it goes back to the RTP grant system. If that is the green sticker you are talking about.

Second - there is only 13 miles of motorcycle trail only on the trail system. There is 80 miles of multi use trails, which are whooped up, and terrible to ride. If there is quality trails perhaps paying a fee isn't bad, but that seems to be a big question??

The volunteers at Lake Delancy are correct, the green stickers should have been enforced about 2 years ago when the program went into effect. The state green sticker program is not, to collect money for the ONF trail system, or to maintain any of the trail systems, that money along with your tax money from gasoline goes into the RTP grant fund.

Well the rangers and volunteers need to stop putting out bad info, they mention it every time I go down there with thier speel on the new trail system.

For the green stickers.

This is what the rangers should be handing out. This is a pamphlet form the DOT. So next time a volunteer or Ranger hands you a line hand him this.

Title Decal Placement
It is important that you affix the decal in the proper location for the off-highway vehicle you own. Use the diagrams below to identify the required location for placement of the OHV decal on your vehicle. Before affixing the decal to your vehicle, be sure the placement area is clean and dry.
If you affix the decal incorrectly, you may be cited by law enforcement.
1. On ATV, place the decal on the left rear quadrant on permanent plastic or metal frame members visible to outside inspection.

2. On OHM, place the decal on the left fork leg, either horizontal or vertical, visible from the left.

It is the intent of the Legislature that all off-highway vehicles purchased after the effective date of the Florida Off-Highway Vehicle Titling Act (July 1, 2002) and all off-highway vehicles operated on public lands be titled to allow for easy determination of ownership.
An off-highway vehicle is defined as any all-terrain vehicle (ATV) or off-highway motorcycle (OHM) that is used off the roads or highways of this state for recreational purposes and that is not registered and licensed for highway use pursuant to Chapter 320, Florida Statutes.
An ATV is defined as any
motorized off-highway or ail-terrain vehicle 50 inches or less in width, having a dry weight of 900 pounds or less, designed to travel on three or more low-pressure tires, having a seat designed to be straddled by the operator and handlebars for steering control and intended for use by a single operator and with no passenger.
An OHM is defined as any motor vehicle used off the roads or highways of this state that has a seat or saddle for the use of the rider and is designed to travel with not more than two wheels in contact with the ground, but excludes a tractor or a moped.
Public Lands means lands within the state that are available for public use and that are owned, operated or managed by a federal, state, county or municipal governmental entity.
When should an Off-Highway Vehicle (OHV) be titled?
• Any off-highway vehicle purchased by a Florida resident on July 1, 2002 or after.
• Any off-highway vehicle purchased by a Florida resident, prior to July 1, 2002, that is operated on unrestricted public lands of this state.


How do I obtain a Florida Certificate of Title for my off-highway vehicle?
New or Used Off-Hiahwav Vehicle Purchased Prior to 07/01/02
1. One of the following must be submitted as proof of ownership:
• A Manufacturer's Certificate of Origin.
• A bill of sale (must include the year, make and vehicle identification number of the off-highway vehicle).
• An affidavit of ownership (must include the year, make and vehicle identification number of the off-highway vehicle).
4. A form HSMV 82040, Application for Certificate of Title, accurately completed by the applicant.
NOTE: If a lien is to be recorded, a lien date MUST be shown.
3. A lien satisfaction(s), if applicable.
NOTE: If a lien is shown on the proof of ownership, submit the proper lien satisfaction or if the lien has not been satisfied and there is no change in ownership, place lien information on an accurately completed form HSMV 82040, ApR)ication for Certificate of Title.
4. Proof of payment of sales tax is not required for an offhighway vehicle purchased prior to July 1, 2002.
5 Title fees in the amount of $38.35 ($29.00 title fee, $425 service fee, $5.10 decal fee.)
Used Off-Hiahwav Vehicle Purchased in Florida. 07/01/02 or after
1. One of the following must be submitted as proof of ownership:
• Florida certificate of title.
• A bill of sale (must include the year, make and vehicle identification number of the off-highway vehicle).
2. A form HSMV 82040, Application for Certificate of Title, accurately completed by the applicant.
NOTE: If a lien is to be recorded, a lien date MUST be shown .
3. A lien satisfaction(s), if applicable.
NOTE: If a lien is shown on the bill of sale, a lien satisfaction is applicable.
5 Title fees in the amount of $3835 ($29.00 title fee, $4.25 service fee, $5.10 decal fee.)


New Off-Hiahwav Vehicle Purchased in Florida or Out of State. 07/01/02 or After
1. A Manufacturer's Certificate of Origin.
2. A form HSMV 82040, Application for Certificate of Title, accurately completed by the applicant.
NOTE: If a lien is to be recorded, a lien date MUST be shown
3. Payment of sales tax.
4. Title fees in the amount of $3835 ($29.00 tiUe fee, $4.25 service fee, $5.10 decal fee.)
Used Off-Hiahwav Vehicle From Out of State. 07/01/02. or After
1. Out of state title.
NOTE: If the off-highway vehicle was not required to be titled, then proof of ownership is a dealer's bill of sale or the registration from that state (if applicable) and a bill of sale from the seller to the purchaser.
The certificate of title, the off-highway vehicle registration (if applicable) or bill of sale submitted as proof of ownership must be in the name of the applicant or must be properly assigned to the applicant.
2. A form HSMV 82040, Application for Certificate of Title, accurately completed by the applicant.
NOTE: If a lien is to be recorded, a lien date MUST be shown.
3. A lien satisfaction(s), if applicable.
NOTE: If a lien is shown on the proof of ownership, submit the proper lien satisfaction or if the lien has not been satisfied and there is no change in ownership, place lien information on an accurately completed form HSMV 82040, Application for Certificate of Title.
4. Payment of sales tax.
5. Title fees in the amount of $3835 ($29.00 title fee, $425 service fee, $5.10 decal fee.)
NOTE: Off-highway vehicles will NOT be issued a license plate, and cannot operate on public highways.
Other types of off-highway vehicles such as swamp buggies or dune buggies do not qualify under this requirement.

Joan - As always, you have excellent information right from the source. ?

Let me add that the volunteers are not completely off base in their comments. ?The fact is, money from the Florida Off-Highway Vehicle Titling Act (July 1, 2002) has been used in Ocala: Grant Update (http://www.floridatrailriders.org/cgi-bin/ikon3/ikonboard.cgi?act=ST;f=20;t=6487) and additional grants were recommended to the DOF last month. ?This money can be used in cooperation with any government agency (fed, state, or even city) to support OHV use across the state. ?However, the cost to make ONF what it could be with this new Family Trail System being proposed is more than the OHV fund can cover. ?In this case, the ONF programs need to be self sustaining like Croom. ?Although much of the OHV fund will be put into grants to maintain trail systems as needed from time to time, I believe the fund is best used to focus on opening NEW places to ride. ?

I hope that helps. ?And take it easy on those volunteers. ?They obviously support our form of recreation and are there to preserve our right to ride. ? Let's give them a pat on the back, rather than shaking a finger at them.

If we can't harass the volunteers, what good are we. We have to keep them on their toes. A pat on the back, maybe.

Actually they do a great job out there... Sometimes it is a tough job but someone has to do it.
